What is Discrimination?
Employment discrimination can include termination, but other actions by an employer can be evidence of discrimination. Adverse employment actions can include failing to promote an employee, reassigning or changing an employee’s job duties, suspensions or write ups, or a loss of employment benefits. Discrimination includes harassment or other behavior that can be shown to harm an employee. Penalizing an employee for complaining about harassment, known as retaliation, can also be a form of discrimination. If your employer has changed your rate of pay, changed your hours, reduced your work responsibilities, or involuntarily moved you to a lateral position, you may be experiencing employment discrimination.
If your employer has refused to accommodate your religious practices you may have a claim for discrimination. Similarly, if you are a person with a disability and your employer has refused to allow a reasonable accommodation so you can perform your job duties you may have a claim.
